Namaya terms of use

1. About these terms

Namaya (the app, the greeting videos and the greeting links) is provided by SoftGenius Software & Services FZCO, IFZA, Dubai, United Arab Emirates (“SoftGenius”, “we”). Our privacy policy explains how we handle personal data and forms part of these terms.

If you downloaded Namaya from the App Store or Google Play, the store's own terms also apply to your download and purchases. Apple and Google are not responsible for Namaya or its content.

2. Who can use Namaya

You must be 18 or older to use Namaya. By using it, you confirm that you are. The greetings you create can be sent to anyone, of any age, as long as they follow these terms.

3. Your account

Namaya creates an anonymous account the first time you open it. It is kept in your iCloud Keychain or Android backup so that your credits follow you to a new phone. You are responsible for the use of the app on your devices. You can delete your account at any time (see Delete your account).

4. Acceptable content

You are responsible for the names and messages you type and for the greetings you send. Do not use Namaya to create or share content that:

• harasses, bullies, threatens or intimidates anyone;
• promotes hatred or violence against people because of their religion, ethnicity, nationality, gender, sexual orientation, disability or any other characteristic;
• is sexual or obscene, or sexualises anyone;
• impersonates a person or organisation, or misleads someone about who sent the greeting;
• contains someone else's private information, such as an address, phone number or ID number;
• is spam, a scam or advertising;
• infringes someone else's rights, or is otherwise illegal.

Only use a person's name in a way you would be comfortable with them seeing. We filter the text you type automatically, and we may refuse to create a greeting that breaks these rules.

5. Your content

You keep any rights you have in the text you type. You give SoftGenius a worldwide, non-exclusive, royalty-free licence to use that text only to create, store, deliver and moderate your greetings, for as long as each greeting exists. You confirm that you have the right to use the names and messages you enter.

6. Reports and takedowns

Anyone can report a greeting that breaks these terms:

• with the “Report this greeting” link on the greeting page; or
• by emailing the greeting link and the reason to info@softgenius.ae.

When a link receives 3 or more reports, it is hidden automatically until we have reviewed it. After review, we either restore the greeting or remove it. We may also remove a greeting at once if it is clearly illegal.

When we remove or restrict a greeting, we tell the sender in the app and give a statement of reasons: what we did, why, and which rule or law it is based on. The sender can contest the decision by replying to info@softgenius.ae, and we will review it again.

We may suspend or block accounts that repeatedly break these terms or misuse the reporting system. Our point of contact for users and authorities is info@softgenius.ae.

7. Greeting links

Anyone who has a greeting link can watch the greeting. Links expire after 12 months. You can delete a greeting from your history at any time, and its link and files stop working at once.

8. Credits and purchases

• Each greeting you create uses one credit. Each account gets one free credit, once, and greetings made with it end with a short Namaya card.
• Credits are consumable in-app purchases, sold only through the App Store or Google Play. The price is shown in the app before you buy.
• Credits never expire.
• Credits have no cash value, cannot be exchanged for money and cannot be transferred to another person's account.
• Refunds are handled by Apple or Google under their refund processes; we cannot issue refunds directly. If a purchase is refunded, the matching credits are removed. If that leaves a negative balance, you cannot create new greetings until it is positive again, but greetings you already sent keep working.
• We may give free credits through promotional codes. Promotional codes are never sold.
• Nothing in these terms limits the rights you have under the consumer protection law of the country where you live.

9. AI voice

Greetings are spoken by a synthetic AI voice, not by a real person, and every greeting is labelled “AI voice”. Do not remove the label or present a greeting as a real recording of a person. Pronunciation of names is our best effort and may not always be perfect; use “Hear it” and “Spell it how it sounds” before you create a greeting.

10. Our app and designs

The app, templates, artwork, music, fonts and voices are owned by SoftGenius or its licensors. You may use Namaya and the greetings you create for personal, non-commercial purposes. Do not copy, resell, reverse engineer or misuse the app or its content.

11. Changes to the service

We add, change and remove occasions, templates, voices and features over time. We work to keep Namaya available, but we cannot promise that it will always be available or free of errors.

12. Liability

Namaya is provided “as is”. To the extent the law allows, SoftGenius is not liable for indirect or consequential losses, or for greetings that users create and share. To the extent the law allows, our total liability to you is limited to the amount you paid us in the 12 months before the claim.

None of this excludes liability that cannot be excluded by law, or limits your rights as a consumer under the mandatory law of the country where you live.

13. Suspension and termination

You can stop using Namaya and delete your account at any time. We may suspend or close an account that breaks these terms, after telling you why, unless the law or the seriousness of the case prevents it.

14. Governing law

If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you can bring a claim before the courts there.

15. Changes to these terms

If we change these terms, we will update the effective date above and, for important changes, tell you in the app before they apply. If you do not agree with the new terms, you can stop using Namaya and delete your account.
